I. GENERAL TERMS
♡ Please don't be rude and try to be as clear as possible when commissioning me.
♡ Provide clear references, possibly being digital ones.
♡ Any ill behaviour will not be tolerated and your commission will be canceled if it occurs.
♡ Follow the rules provided in the commission journal, YCH or Adoptable deviation. If you fail to follow the rules provided I have the right to decline your commission.
II. PAYMENT
♡ All commissions must all be paid in full upfront. However, if the price your paying exceed 100€ you may pay half of the total price upfront, and the rest may be payed after you received your commission.
♡ I accept EUR, USD and Deviantart points (note that 1 EUR = 100 dA points, and 1 EUR = 1,12 USD). The points shall only be paid through the commission widget unless stated otherwise.
III. PROCESS
♡ A sketch will be given to you to check: any error or edit to the drawing will be applied without an extra charge during that phase.
♡Further WIPs will be given out regularly (lineart, flat colors) once in a while if the commission is taking longer than expected. If you'll ask for more WIPs they will be given to you. However, edits during this phase will have an extra charge of 0.50 EUR per edit.
♡ The time for your commission to be completed can vary depending on many factors such as;
Health, order of commission, complexity, Work, school or family issues. If the commission will take more than one month to be completed, you'll be notified.
​IV. CUSTOMER SATISFACTION
♡ I will do everything I can to make my customers happy.
♡ However after a commission is finished only small changes (such as small markings, little details etc) are allowed to be made and they'll cost 0.75 EUR per change. Any great changes will come with an extra charge (Such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely) depending on how big the edit will be.
♡ If your reference was unclear to start with, then you are not allowed to do minor changes without a fee. Make sure to be clear in your order what you aim for.
V. COPYRIGHT / USAGE POLICY
♡ I, the artist, hold every right to the produced drawing, not the commissioner. Therefore I´m allowed to use the copyrighted artwork to;
♡ Promote myself with in any place or site.
♡ Publish books with.
♡ To display it anywhere to my liking.
♡ Post it wherever I want.
The commissioner are allowed to;
♡ Use the copyrighted artwork for personal use only unless agreed otherwise.
♡ Print the art, and claim the right of their character(s) but not the drawing itself.
♡ Use the art to promote themselves with proper credit given to the artist.
♡ If you break the copyright infringement in any way, every right you had to the drawing will be retracted.
The following is considered Copyright infringement:
♡ Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way)
♡ Taking Credit for the creation of the artwork.
♡ Removing any watermarks/signatures.
♡ Altering the artwork without my, the artist´s, consent.
♡ A Purchase of Commercial rights to the artwork will always be 300% of original price.
♡ With commercial rights you are allowed to make any sort of merch with the artwork.
♡ Use it in books, covers, as Props, change it to your liking and promote your own brand with.
♡ Credit is still required for usage of the artwork, even if altered or edited.
VI. CANCELING/REFUNDING POLICY
♡ I have the right to cancel and refund the money for you commission at any time.
♡ You may ask for a refund only if I'll be taking too much time and I'm not giving you any update or whatsoever.
♡ If money has not been sent yet the commissioner has the right to cancel the commission.
♡ If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.
♡ You will forbidden to ever commission me, ChosenUndeaad, ever again.
♡ Your name will be publicly posted everywhere I want to for others to watch out for.
♡ I also have every right to file a complaint and I have all the right to the money you have given me.
Any statement can be bound to change if discussed with me, the artist, prior to the commission.
Failure to follow these rules will result in a warning, which will become a block/blacklist if rules are repeatedly broken.
REGARDING DESIGNS/ADOPTABLES
I. RESELLING/TRADING
​♡ Designs may be resold if you purchased them either from me or another user without the need to notify me.
♡ Designs may be traded for other designs, art and any other kind of good.
♡ Designs may be gifted to other users.
♡ Once you re-sell/trade/gift the design, it is no longer yours.
♡ Designs may be sold for an higher price only if they have extra art. However, before doing so you may contact me to check that the new price is appropriate.
♡ If the design is part of a closed species, before reselling/trading/gifting it you MUST, under any circumstances, contact me first. Without my approval, you are not allowed to give away the design.
Do not
♡ Charge extra money if there's no additional art to the design.
♡ Resell a design that hasn't been purchased for money. You're allowed to resell said design only if there's additional, commisioned art that you personally paid for.
♡ Resell/trade/Gift a closed species desgin without my permission.
II. CO-OWNING
♡ My designs can be co-owned. However, you'll need to note me about it first.
♡ You are not allowed to co-own a design with someone that has been put on my blacklist.
III. RECOLORING/EDITING
♡ Edits on the original artwork aren't allowed. If you'd like to change something, please do a new artwork by yourself. You're however required to keep the original artwork if you'd like to give away the design.
♡ Small changes to the design are allowed, as long as it will remain close to the original design.
♡ Changes and recolors on a closed species aren't allowed. However, if the change is minor, please feel free to contact me and we will work it out and see if it's possible.
Do not
♡ Take payments to edit on top of my artwork, or pay others to edit on top of my artwork. Please make/get new art if money for edits is involved.
IV. PRODUCT QUANTITY
♡ If you purchase a single design from me, you are not allowed to split it off into multiple designs. It must remain as a single design.
♡ This includes breeding. You're not allowed to use my design for any form of breedables.
V. COMMERCIAL RIGHTS
♡ You are not allowed to use my art of the design for profit in any way without buying commercial rights first. To do so, refer to my general TOS (paragraph V).
♡ You are allowed to include my designs in games/comics/videos and other mass media consumed materials, as long as it is not my or any other artist art without their explicit permission.
♡ You may make charms/shirts/prints/business cards/post cards featuring the character you have purchased, so long as they are made in limited quantity, and the art is YOUR OWN art, or art purchased -from another user with explicit permission from them to use their art in such a way.
VI. RE-POSTING
♡ You may repost artwork/design you've received to display them as yours, however you are required to downsize/watermark it for completely public display. My un-watermarked images are given to people so they may see things clearly or provide them in private for commission references, but should not be posted in the open for the sake of the protection of the art.
♡ If posted, you must credit me for the original artwork and the design.
VII. PROPER USAGE
♡Publicized art of my designs that include subjects such as:
sexual artwork with children, hate speech & racism toward real-life races
Will NOT be tolerated, and you will be warned.
Failure to follow these rules will result in a warning, which will become a block/blacklist if rules are repeatedly broken.
